EPA Section 34 — the penalty bands explained

Section 34 is the enforcement teeth behind the Duty of Care. The penalty bands are wide and the Sentencing Council's Environmental Offences guidelines are explicit about the aggravating factors that move you up them. Understanding the bands is the first step in understanding the exposure — and in justifying the modest investment in records that keeps you out of the higher bands.

Fixed-penalty band — £300–£1,000

Paperwork failures: missing WTNs, incomplete carrier details, untimely transfers. Almost always avoidable by having a system that produces compliant WTNs at the point of transfer. The Fixed Penalty Notice is the regulator's lightest touch, and it is increasingly used as a way to formalise a warning rather than escalate to prosecution. Multiple FPNs against the same operator within a 12-month window typically escalate to the next band.

Magistrates' Court band — up to £50,000

Substantive breaches: knowingly transferring to an unlicensed carrier, persistent failure to retain records, misdescription of waste, failure to register hazardous waste premises. Director-level liability becomes a serious possibility at this band — the Section 157 'director liability' provision applies where the offence was committed with the consent, connivance or attributable to the neglect of a director or senior officer. Practical implication: a single magistrates'-court conviction can carry directly to a director's personal record.

Crown Court band — unlimited

Major breaches, environmental damage, repeat offending, or hazardous waste handled outside the consignment regime. Aggravating factors include cost-saving as a motive, lack of system controls, substantial environmental impact, and lack of cooperation with the investigation. Crown Court fines in environmental cases have run into seven figures, and custodial sentences have been imposed for directors involved in the most serious breaches.

Aggravating and mitigating factors

The Sentencing Council guidelines weigh culpability and harm. High culpability includes deliberate breach, profit motive and disregard for advice; low culpability includes minor procedural failures with no environmental harm. The mitigating factors that most reliably reduce the penalty are: voluntary disclosure to the regulator, immediate and effective remediation, system improvements demonstrated at sentencing, and a clean prior record. All of these benefit from a paper trail.

Worked example — a paperwork failure that escalated

A construction operator was found to have transferred waste to a carrier with an expired licence. The transfer itself was inadvertent — the operator had no system for checking carrier registration. The Magistrates' Court fined the company £18,000 and imposed costs of £7,000; the director was personally fined £2,500. The penalty would have been an FPN if the operator had documented carrier-check evidence and could demonstrate the lapse as a one-off. The cost of a system that automates carrier checks is a fraction of the penalty.

Worked example — a Crown Court case

A waste-management company was prosecuted in the Crown Court after a pattern of unregistered hazardous-waste handling. The company was fined £1.8m and the managing director received a 12-month custodial sentence. The aggravating factors cited at sentencing included sustained breach over multiple years, cost-saving motive, and lack of any internal compliance system. The case is at the high end of the spectrum, but it illustrates the trajectory from poor records to existential exposure.

The cheapest insurance

A compliant records system costs four or five figures a year. The penalty bands run from low four figures to seven figures, with personal liability and potential custodial exposure at the top. As insurance against regulatory action, a records system is the highest-leverage investment a waste-producing business can make.

Takeaway
